John Elven, Director of Elven Consult, is an expert in dispute resolution and avoidance, supporting major contracting businesses in the construction industry. John provides contractual and commercial advice with informed recommendations in situations where disputes have arisen and require practical solutions.
John has gained considerable experience over the best part of a 30 year career in respect of a variety of construction activities such as building, groundworks, drainage, infrastructure, major roadworks, water treatment works, pipelines, marine cabling, utilities, energy, demolition and remediation.

Dispute Avoidance and Resolution
ADJUDICATION
Specialising in the preparation of cases for adjudication whereby John frequently acts as party representative. John has referred numerous disputes related to matters such as payments, extensions of time, loss & expense, final accounts, contract rates, weather-related compensation events, KPI’s, discounts, contra charges, termination, final certificates, unforeseen ground conditions, Section 106 agreements and the impact of delays by statutory undertakers.
CONTRACTUAL & COMMERCIAL ADVICE
Provision of contractual reviews to assess risk and then report to the client (with experience of NEC, JCT, FIDIC, ICE and bespoke contract forms). Commercial: provision of audits, reviewing existing procedures and providing recommendations to improve business processes. Valuation and assessment of final accounts (including termination / insolvency cases), change management, reviewing final statements / certificates, providing a watching brief on live projects (e.g. monitoring adherence to contract mechanisms and ensuring that contingencies are in place to minimise disputes).
Advising clients' commercial teams in respect of claims preparation, assessment of compensation events, preparation of interim and final accounts.
DELAY ANALYSIS AND PROGRAMMING
Provision of high-level delay reports and detailed delay analyses using a variety of SCL approved methods, reviewing expert reports, producing cause & effect narratives, using baselines to demonstrate delays, reviewing the impact of compensation events on Accepted Programmes, and producing As-Built programmes based on contemporaneous records. Also, ascertaining Loss & Expense / Additional Costs arising in connection with delay & disruption.
TRAINING
Elven Consult provides workshops & seminars in respect of matters such as: dispute avoidance, risk management, assessment of extensions of time under NEC & JCT, NEC Compensation Events & Programmes. Workshops are typically provided to reflect standard contract provisions, albeit these can be adapted to reflect specific contract amendments and requirements.
